Cascade agreed to accept the 2004 Agreement Regarding Reservoir Management between Puget and the Lake Tapps Community as part of its purchase of Lake Tapps and further reiterated its desire to establish a long-term relationship with the Community for cooperative management of the Lake. The Cascade board recognized the 2004 agreement needed to be amended and that a revised agreement will retain the key elements of the current agreement, such as the Annual Recreational Period, Normal Full Pool and a Lake management team.

Key provisions of the 2009 Agreement include:

• Maintenance of Recreational Lake Levels at Normal Full pool
  - From April 15 through September 30
  - From April 15 through September 15 once the Water Supply Project is operational (90% of the time from September 16 through September 30)
  - As reasonably possible from October 1 through October 31
• Lake Management Team to plan annal operations as related to Recreational Lake Levels
• Development and implementation of a Communication Plan
• Community right of firet offer/match/last offer to acquire Lake
